Oral arguments in the case brought by the Organic Seed Growers and Trade Association against Monsanto will be heard January 10, 2013, at the Court of Appeals for the Federal Circuit in Washington, D.C., reports Bangor Daily News. The organic seed growers association, along with 82 plaintiffs, in March 2011 sued Monsanto in federal district court in New York. The New York judge dismissed the suit before it went to trial. The 83 plaintiffs, including independent farms, seed companies, and agricultural associations around the country, appealed the case. Two amicus briefs have been filed in support of the plaintiffs, one by 11 law professors and the other by 14 nonprofit consumer and food safety nonprofit groups. Three appellate court judges will hear the case and at least two of them will have to vote to send the case back to district court in order for the case to continue.
